By downloading, installing, or using Maxine ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the App.

Maxine is developed and published by donnywals.com BV, a company registered in the Netherlands ("we," "us," or "our").

2. License and Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms and Apple's App Store Terms of Service.

You agree not to:

• Copy, modify, or distribute the App or any part thereof.
• Reverse engineer, decompile, or disassemble the App.
• Use the App for any unlawful purpose.
• Attempt to circumvent any security features of the App.

3. In-App Purchases and Payments

Maxine offers optional in-app purchases to unlock additional features. All purchases are processed through Apple's App Store.

Apple is the merchant of record for all transactions. Your purchase agreement is directly with Apple, not with donnywals.com BV. As such:

• All payment processing, billing, and refunds are handled exclusively by Apple.
• donnywals.com BV cannot process refunds, resolve payment disputes, or access your payment information.
• For any payment-related issues, refund requests, or billing inquiries, please contact Apple Support directly or manage your subscriptions through your Apple ID settings.

4. Medical Disclaimer

Maxine is not a medical tool and does not provide medical advice.

The App is designed to help you track your workouts, set fitness goals, and view performance insights. Any guidance, suggestions, insights, or recommendations provided by the App are for informational purposes only and should not be considered professional medical, health, or fitness advice.

The one-rep max estimates, workout suggestions, and other insights are based on general formulas and algorithms. They are not personalized medical recommendations and may not be accurate or appropriate for your individual circumstances.

Before starting any exercise program or making changes to your fitness routine, consult with a qualified healthcare professional or certified fitness trainer.

5. User Responsibility and Safety

You are solely responsible for exercising in a safe manner.

When using Maxine or following any insights or suggestions from the App:

• Always prioritize your safety and listen to your body.
• Use proper form and technique when performing exercises.
• Do not attempt weights or exercises beyond your current ability.
• Stop immediately if you experience pain, discomfort, or unusual symptoms.
• Ensure you are in a safe environment with appropriate equipment.
• Consider working with a spotter when lifting heavy weights.

donnywals.com BV is not responsible for any injuries, health issues, or damages resulting from your use of the App or from following any guidance provided by the App.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will meet your specific requirements.
• The App will be uninterrupted, timely, secure, or error-free.
• The results or calculations provided by the App will be accurate or reliable.
• Any errors in the App will be corrected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, donnywals.com BV and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

• Your use or inability to use the App.
• Any injuries or health issues resulting from exercises performed while using the App.
• Any unauthorized access to or alteration of your data.
• Any other matter relating to the App.

8. Intellectual Property

The App, including its design, graphics, text, and other content, is owned by donnywals.com BV and is protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or other proprietary information without our prior written consent.

9. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting the updated terms on this page. Your continued use of the App after any changes constitutes acceptance of the new terms.

10. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
